Title of goods shall not pass until payment has been received in full.
Any work carried out in addition to the original estimate/quote will be charged at the discussed and agreed amount.
Estimates/Quotes are valid for a period of 3 months from issue. After receipt of a firm order, prices are guaranteed as fixed for 3 months.
Payment terms are as printed on the estimate/quote; other payment terms maybe agree in individual circumstances and will be confirmed in our written order confirmation.
Problems resulting in inaccuracy of drawings or dimensions supplied by the customer shall not become our responsibility. Any additional work or time taken as a result shall be chargeable.
Booking-in payment is non-returnable after agreed start dates and/or fourteen days after receipt of payment.
Opulent Pools Ltd will endeavour to start the works on the agreed start date, however, due to extreme weather condition, the start date might have to be moved to the next available window of opportunity.
We will discuss with the customer the possible ground makeup and estimate the agreed outcome of those discussions. Any unforeseen subterranean buildings/obstructions or hydrostatic water problems will be estimated for as and if they occur.
Whilst we will endeavour to maintain the entry and exit points to their existing condition, it is inevitable that some signs of disturbance will occur. We will of course remedy this after construction has been carried out.
While we can provide estimates and quotes based on the customer’s drawings and specifications, Opulent Pools is not responsible for architectural or planning expertise. We do not supply technical, structural, or design drawings. However, these services can be arranged at an additional cost. We are able to work with drawings provided to us, but we do not accept liability for any errors or inaccuracies contained within the supplied drawings.
Any delays incurred by Third Parties shall be charged at the daily rate of £500+VAT (20%).
We reserve the right to publish photographs of a clients project on our website and for promotional purposes.
A binding contract is formed when the Client accepts a quotation issued by Opulent Pools in writing, by email, by signature, or by payment of any deposit or stage payment. These Terms & Conditions form part of that contract.
The works shall be carried out in accordance with the agreed quotation, drawings, specifications, and any subsequent written variations agreed between the parties.
Payments shall be made strictly in accordance with the agreed payment schedule.
All stage payments become due upon completion of the relevant stage, regardless of whether the Client chooses to delay, suspend, or terminate the remaining works.
Failure to make payment when due constitutes a material breach of contract.
All materials, equipment, and products ordered by Opulent Pools for the project are ordered specifically for the Client.
Materials ordered, delivered, or in stock remain payable in full once ordered.
Deposits paid to third-party suppliers are non-refundable.
Title to all goods remains with Opulent Pools until paid for in full.
Opulent Pools reserves the right to retain or remove unpaid materials from site.
Supplier invoices, trade pricing, and commercial arrangements remain confidential and are not disclosed.
In the event of termination by the Client, The Client shall immediately pay:
All works completed to date.
All materials ordered, delivered, or in stock.
All outstanding balances on products where deposits have been paid.
Any reasonable costs incurred as a result of termination.
Termination does not remove the Client’s obligation to pay for completed works or ordered materials.
Opulent Pools reserves the right to suspend or terminate works where:
Payments are overdue.
The Client interferes with the works.
Health and safety is compromised.
Instructions are issued that differ materially from the agreed scope.
In such cases, payment remains due for all works completed and materials ordered.
Any changes to the scope of works must be agreed in writing.
Variations may affect programme, cost, and completion dates.
Opulent Pools shall not be liable for delays caused by:
Client instructions or indecision.
Design changes.
Weather conditions.
Supplier lead times.
Site access issues.
The Client shall provide clear and uninterrupted access to the site.
Opulent Pools will take reasonable care but accepts no liability for unavoidable disturbance to surrounding areas during construction.
All designs, drawings, methods, and construction details remain the intellectual property of Opulent Pools and may not be used, copied, or passed to third parties without written consent.
Opulent Pools’ liability is limited to the value of the works carried out.
We shall not be liable for indirect or consequential losses.
This contract is governed by and construed in accordance with the laws of England and Wales.
All works are carried out subject to Opulent Pools’ Terms & Conditions.
